1. About These Terms
This website (www.petabite.com.au) is operated by Petabite Pty Ltd (ABN 60 688 673 494) (“Petabite”, “we”, “us”, “our”).
By accessing this website, placing an order, or creating an account, you agree to be bound by these Terms of Service and all policies referenced within them, including our Privacy Policy, Refund Policy, Shipping Policy, and Subscription Policy. Please read these terms carefully before using our site or purchasing from us.
2. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), which forms Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms of Service is intended to exclude, restrict, or modify any rights or remedies you may have under the ACL or any other applicable law that cannot be excluded or modified by agreement.
If a product we supply has a major failure (as defined in the ACL), you are entitled to:
• reject the goods and choose a refund or replacement; or
• keep the goods and recover compensation for the reduction in value.
If a product we supply has a minor failure, we may choose to repair the goods, replace the goods, or refund you, within a reasonable time.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage resulting from a failure that could have been reasonably foreseen.
3. Products and Pricing
All prices on our website are displayed in Australian dollars (AUD) and include Goods and Services Tax (GST) where applicable.
We take reasonable care to ensure that product descriptions, images, and prices on our website are accurate. However, we reserve the right to correct any errors or omissions and to update product information, packaging, and pricing at any time without prior notice. If we discover an error in the price or description of a product you have ordered, we will contact you before dispatching the order and give you the option to proceed at the correct price or cancel for a full refund.
4. Orders and Payment
When you submit an order through our website, it constitutes an offer to purchase. An order is accepted by us when we send you an order confirmation email. Until that point, we may decline or cancel an order for any reasonable reason, including if a product is unavailable, if we identify a pricing or description error, or if we reasonably suspect fraudulent or improper activity.
Payment is processed securely through our third-party payment providers, Stripe and PayPal. By submitting an order, you authorise us and our payment partners to charge your selected payment method for the total amount shown at checkout, including the product price, shipping, and any applicable taxes.
We do not store your credit card or payment credentials. All payment data is handled directly by our payment providers in accordance with their own security and privacy policies.
5. Pre-Orders
From time to time, we may offer products for pre-order. When you place a pre-order, your payment method will be charged at the time of purchase unless otherwise stated at checkout. We will provide an estimated shipping date for pre-order products on the product page and/or at checkout.
If there is a material delay beyond the estimated shipping date, we will notify you by email and provide an updated timeline. If you do not wish to wait, you may cancel your pre-order at any time before the product has been dispatched and receive a full refund. Your rights under the ACL are not affected by pre-order terms.
6. Subscriptions
If you choose a subscription, you select the product, quantity, and delivery frequency (every 4, 6, or 8 weeks). You authorise us and our subscription management partner (Recharge) to charge your payment method automatically for each renewal until you modify or cancel your subscription.
There is no fixed contract period and no cancellation fee. You may change, pause, skip, or cancel your subscription at any time through your subscription portal or by contacting us. For full details, please see our Subscription Policy.
7. Product Use
Our products are designed for use as domestic cat litter only and should be used in accordance with the instructions provided on the packaging and our website. We are not liable for any damage, loss, or injury arising from use of our products for any purpose other than their intended use, or from failure to follow the instructions provided, except where such liability cannot be excluded under the ACL.
8. Intellectual Property
All content on this website, including text, images, graphics, logos, product names, and website design, is owned by Petabite Pty Ltd or its licensors and is protected by Australian and international intellectual property laws, including copyright, trade mark, and design rights.
You may view, download, and print content from this website for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, or use any content from this site for commercial purposes without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, and subject always to Section 2 (Australian Consumer Law) of these Terms:
(a) Petabite will not be liable for any indirect or consequential loss, including loss of profit, loss of data, loss of opportunity, or any damage arising from events outside our reasonable control.
(b) Our total aggregate liability to you for any claim arising under or in connection with these Terms, other than under the consumer guarantees in the ACL, is limited to the amount you paid for the relevant product or order giving rise to the claim.
(c) Nothing in this section excludes or limits liability that cannot be excluded or limited under the ACL or any other applicable law.
10. Your Account
If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at info@petabite.com.au if you become aware of any unauthorised use of your account.
11. Privacy
We collect and handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. By using our website and services, you consent to the collection and use of your information as described in our Privacy Policy.

We are not responsible for the content, privacy practices, or availability of any third-party sites. These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any dispute arising under or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of Victoria.
Before commencing legal proceedings, we encourage you to contact us to attempt to resolve any dispute informally. You may also access external dispute resolution services, including through your relevant state or territory consumer affairs agency or the Australian Competition and Consumer Commission (ACCC).
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
